From the way he made it sound, on TB2003 it was something that they consulted Mike about, rather than just put there without asking him. Whether they will consult him a second time is another matter of course, but it does seem that if he has any say, it'll be without copy protection.
I think they'd be silly to ignore it as a factor in Tubular Bells 2003's disappointing sales (though knowing record companies, they'll porobably blame that on piracy too and release his next album etched onto on a stone tablet that nobody can play). There are of course many reasons why it charted lower than any other of the Tubular Bells albums (in the UK, number 50 as opposed to 3 for TB 3, and number 1 for TB 1 and 2), and why it disappeared out of the charts so quickly, but I'd imagine that the copy protection issue can't have helped.
